NHI: A Defining Moment As South Africa Awaits The 5–7 May 2026 Constitutional Court Ruling
South Africa’s National Health Insurance (NHI) journey has reached a defining moment, not through implementation, but through a pause. While the NHI Act was signed into law in 2024, its rollout has not yet begun. In a significant development, the President has agreed not to proclaim any sections of the Act into operation pending the outcome of ongoing legal challenges.
As a result, the implementation of NHI is effectively on hold. At the centre of this pause lies a critical Constitutional Court hearing scheduled for 5–7 May 2026, which will determine the constitutional validity of aspects of the Act, particularly the legislative process that led to its adoption.
From Policy Reform To Constitutional Matter
The NHI was conceived as a bold reform aimed at achieving universal health coverage — ensuring that all South Africans have equitable access to quality healthcare, regardless of socio-economic status.
However, the conversation has now shifted. What began as a policy and health systems reform debate has evolved into a constitutional matter, with multiple stakeholders, including healthcare funders and provincial governments challenging the process and implications of the legislation.
The upcoming Constitutional Court ruling will therefore not only determine the immediate future of NHI but also shape the broader trajectory of healthcare reform in South Africa.
What The Current Pause Really Means
It is important to be clear: NHI is not currently being implemented.
No sections of the Act have been proclaimed, and no operational rollout is underway. However, this does not mean that progress has stopped entirely.
Government has indicated that preparatory work continues, including efforts to strengthen the public healthcare system and build the foundational elements required for future implementation. In essence, what this means is that policy implementation is paused while system preparation continues.

A Healthcare Sector in Uncertainty — and Opportunity
The current moment is characterised by uncertainty across the healthcare sector. Healthcare professionals, funders, policymakers, and patients alike are navigating an environment where the future direction of the system remains unclear. This uncertainty has several implications, such as:
- Delayed decision-making and investment
- Ongoing debate about the role of public and private healthcare
- Concerns around system readiness and sustainability
Yet, within this uncertainty lies an opportunity to pause, reflect, and ask the most important question of What kind of healthcare system do we want to build and how do we ensure it is sustainable, inclusive, and effective?
The Importance of Getting It Right
Regardless of the outcome of the Constitutional Court ruling, the one principle that remains clear is that healthcare reform at this scale must be carefully designed, widely supported, and practically implementable.
South Africa is not short of talent. Across the country, healthcare professionals continue to deliver exceptional care, often under challenging conditions. The success of any future system, including NHI, will depend on:
- Strengthening healthcare infrastructure
- Investing in the training and retention of professionals
- Ensuring meaningful stakeholder engagement
- Building trust across the system
Because healthcare is not only about policy, it is about people.
The role of SAMDP in this moment
At the South African Medical and Dental Practitioners (SAMDP), we recognise that this is a critical moment for the profession and the country. Our role is not only to observe these developments, but to actively contribute to the conversation. We believe that healthcare professionals must be central to policy discussions, the voice of practitioners must inform system design and collaboration across sectors is essential.
SAMDP remains committed to providing clarity to its members, advocating for the interests of healthcare professionals and supporting a healthcare system that is equitable, sustainable, and responsive.
A Turning Point in South Africa’s Healthcare Reform
The Constitutional Court hearing in May 2026 will be a defining moment. It may enable the NHI to move forward, it may require aspects of it to be revisited or it may reshape the path entirely. But beyond the legal outcome, the broader question remains-how do we build a healthcare system that truly works for all South Africans?
An Opportunity to Strengthen the Future
The future of healthcare in South Africa will not be determined by policy alone — but by the choices we make, the voices we include, and the system we build together. Therefore, this pause must not be looked at as the end of the NHI journey but as a moment of reflection and an opportunity to get it right. If approached thoughtfully, inclusively, and strategically, this moment could strengthen the foundation of South Africa’s healthcare future. Because ultimately, the goal remains unchanged: A healthcare system that delivers quality, dignity, and access for all.
