Children’s Rights and the Constitution

Section 28 of South Africa’s Constitution enshrines children’s rights, mandating family care, shelter, healthcare, education, and protection from abuse as legal obligations for all.

At its core, the guiding principle “in the child’s best interest” acts as a moral and legal compass, underscoring the country’s commitment to prioritising children’s needs. Children are among the most vulnerable members of our society, depending on families, communities, and government to protect their health and well-being.

The Constitution asserts that children’s best interests are paramount, making it everyone’s responsibility to ensure they grow up in a safe, nurturing environment. Realising these rights isn’t merely a legal obligation but a moral imperative to secure a healthy, productive future for our nation. Our actions today directly impact the kind of society we build tomorrow.
